Before the manger fires the jobholder, personnel can lead them back into the fold. If you conduct the dismissal properly, the jobholder will be more probably to recover quickly and move on with dignity. Use a Sample Written Memorandum of Lay off. If you eventually layoff an bad, incapable employee, that individual may retaliate against the company by filing a wrongful lay off law suit. Again use third-party corroborators, like Human resources Workforce, to work on your behalf. In the next chapter, you'll learn how to investigate and document an incident of gross misconduct. However at times managing insubordinate employees is tougher.
